2. Software Functionality
Ting is designed to capture, transcribe, and analyze data from telephone and video calls, emails, and other forms of written communication to generate actionable insights for Client use. This process involves advanced AI technology for the automated analysis of the content to deliver comprehensive insights into customer interactions.
3. User Obligations
3.1 Access Requirements
Users are responsible for obtaining and maintaining all necessary equipment, including connectivity, computer or mobile software, and hardware, to access and use Ting. All costs associated with such access and use are the sole responsibility of the user.
3.2 Compliance
Users must ensure their use of Ting complies with all applicable local, national, and international laws and regulations. Users are solely responsible for such compliance and indemnify the Company against any claims arising from non-compliance.
4. Restrictions on Use
Users are prohibited from:
- Engaging in any activity that disrupts or interferes with the functionality of Ting.
- Attempting to bypass any measures designed to prevent or restrict access to Ting or any portion thereof.
- Using the software for any unlawful purpose or in violation of any local, state, national, or international law.
- Reverse engineering, decompiling, or disassembling Ting, except where permitted by law.
5. Intellectual Property Rights
Users are granted a non-exclusive, personal, non-transferable license to use Ting. All intellectual property rights in the software remain with Ting or its licensors. All intellectual property rights in Ting and the underlying technology, including software, algorithms, interface design, and logos, are owned by the Company or its licensors. No transfer of intellectual property rights is implied.
6. Termination
The Company reserves the right to terminate or restrict access to Ting if a user violates these Terms or engages in activity deemed harmful to Ting, the Company, or other users.
7. Disclaimers and Limitation of Liability
Ting is provided on an “as is” and “as available” basis. The Company makes no representations or warranties of any kind, express or implied, as to the operation of Ting. To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. The Company will not be liable for any damages of any kind arising from the use of Ting.
8. Jurisdiction and Dispute Resolution
These Terms will be governed by and construed in accordance with the laws of Spain, without giving effect to any principles of conflicts of law. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona.
9. Changes to Terms
The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. By continuing to access or use Ting after those revisions become effective, you agree to be bound by the revised terms.
